i just disagree. The guy's a judge. He was always careful about what was fact and what was opinion, but he didn't go around defensively qualifying his opinions, either. You had to take the cue from context.It was stated like he believed it was a fact.
Not only is he a judge, but he's a federal judge. Difference between a federal judge and a state court judge is like the difference between Alabama's football team and Belen's team.

Not always. The New York State Court of Appeals, when Cardozo was Chief Judge, was a highly-regarded court, and issued many decisions that define our law to this day, including the notorious Palsgraf.
