Seems pretty clear to me that Wisconsin knew Lucas was likely gonna leave. So they pressured him to sign the rev sharing contract and told him he was locked in no matter what, after he signed it. Thankfully he retained a lawyer that explained to him it didn’t mean **** bc that agreement hasn’t been approved.
 

Statement UW.

We entered into an illegal agreement with a student athlete in hopes of blocking him from seeking a real NIL deal at another school. We hope someday soon such agreements are legal and we can really put it to our student athletes and totally control whether they can leave like the good old days. To be clear, players who don’t workout are still encouraged to leave.

I just don’t understand the remedy. Do they want to claim tortious interference? I don’t see damages, unless they want to be transparent and detailed about pay to play. Specific performance of personal services is out.

If they choose to litigate it would seem they would allege tampering/tortious interference per UW's and the big ten's press release. My understanding is that parties/member schools can litigate a violation of rules promulgated by a private association: i.e. the NCAA.
They'd probably allege monetary harm to UW resulting from UM's "tampering" (if provable). But you'd know better than me.

As far as remedy, I guess they'd either seek specific performance (returning Lucas to UW an admittedly farfetched and absurd remedy) or money damages plus punitive resulting from UM's "tampering".

To me, this all seems like noise to set up the true goal: getting Congress to grant the NCAA a legal “safe harbor” from all its antitrust violations.

The Big 10 put out a statement which basically said: “ACC, you’re supposed to be with us in maintaining the facade that this House settlement is sustainable. Congress, please clean up this mess.”

The NCAA in court is comparable to Kirby Freeman against NC State. They need to a lifeline from Congress to maintain the scam.

No cause of action for violating an association rule.

You can only interfere with an enforceable contract.

No way to prove damages.

We abolished slavery. You cannot force someone to provide personal services through a decree of specific enforcement.

And many, many other problems.

I could write a journal article on all the reasons WI will not sue and could not prevail.

And in Fed court they're toast as you noted.

If UW could litigate this in Wisconsin state court it would be their only chance. Hence my original question about likely venue.
 
I just want the chance to meet this Jeffrey Dahmers whisky fan one on one in a cell.
