I'd be more impressed if this was a US Senator or Representative doing this, but I'll take whatever I can get.

I think Shalala has more influential friends than Mr. Abruzzo, some slapdick state rep. The guy just wanted to get his name in the paper. Additionally, Orrin Hatch, chairman of the Senate Judiciary Committee, went after the NCAA previously with no effect. Again, Mr. Abruzzo is of little consequence.
 
might also want to copy the IRS to add to that the the NCAA:

1) paid approximately $20,000 of membership funds (no doubt - (to be?) deducted - and booked as "attorney fees" necessary for association legal business) to "hire" a lawyer who now claims the NCCA was not her client [oh and she says they still owe her another $40,000 or so]
According to admissions from both the lawyer and the association, the funds were actually disbursed not for legal representation of the association but, instead, to secure the attorney's sham participation in a federal legal proceeding - i.e., under the ruse of representing a felon bankruptcy-debtor, the lawyer was by agreement to conduct depositions actually olchestrated and scripted by the ncaa, a non party to the bankrupcy proceedings, to obtain information not otherwise subject to the memberships' grant of authority to the association. All to the expense, again, of creditor-victims of the felon debtor.


2) along those lines, the association also paid that incarcerated felon membership funds of over $10,000 funds (to his commisary funds, for a burn phone, etc.) to secure his (favor? testimony?) participation in a civil enforcement investigation, no doubt - to be deducted - and booked as ordinary and necessary business? expenses. Query? Is this a proper "ordinary and necessary" business expense? There is also some question as to whether the payment of funds in this amount, given to a bankruptcy debtor, needed to have been first run past the bankruptcy trustee (did this happen, should the funds, rather, have become part of the bankruptcy estate?).

The NCAA collects funds from its membership and is to disburse those funds for specific purposes auathorized, were these disbursements of membership funds within authorized parameters?

The association members no doubt agreed that that the association should be funded to conduct investigations, they did not give the association subpoena powere. I'm reasonably sure the membership didn't understand and agree the funds would be used contrary to membership agreement, used to circumvent the intent of federal court proceedings (in clear violation of public policy) and to curry favor with a an evidently poorly corroborated and convicted liar. (All to? uncover evidence of unethical dealilng?)


PS I used to think Emmert had merely driven his career into a bar ditch, its far bigger than that.
After this fiasco college sports will begin to ask, what was the last NCAA investigation that was sucessfully and properly conducted by the NCAA? USC?, Cam Newton?, Patrick Peterson?, UNC? - players were eligible "attending fake classes", no biggie. FSU academic gate? no biggie, Oregon? Pen State? and now the U? keystone cops meet inspector clueseau (as said the Wahsington post, i believe.)

What has the NCAA done with the allignment chaos? How bout BCS playoffs?

The NCAA is finished, dead man walking, they should have settled this thing quietly. (and the story will continue, and continue, eg. MEP is stil out there, saying things like, :If I DID ANYTHING WRONG I'M SURE I WOULD HAVE HEARD FORM THE BANKRUPTCY JUDGE.....tick, tick, tick, tick.....)

Shapiro thought he would use the NCAA to bring down the U (He has in effect said so.) History will record that in fact, by getting into bed with the likes of MEP and Shapiro, the NCAA instead will havae brought down the NCAA.

Sen. Joe Abruzzo to FL Attorney General Pam Bondi: investigate NCAA 'abuse of power' in UM case

State Sen. Joe Abruzzo, D-Wellington, wants Florida Attorney General Pam Bondi to investigate the NCAA for its tainted investigation into the University of Miami. Abruzzo, who doesn't look like he attended UM, cc'd U.S. Attorney General Eric Holder in the following letter:

I respectfully request that your office begin an investigation into the National Collegiate Athletic Association’s (NCAA) actions during its probe of the University of Miami’s athletic program.

NCAA Enforcement Staff violated its own rules and engaged in corrupt behavior in an attempt to manufacture misdeeds against the University of Miami. In so doing, the NCAA has demonstrated a lack of institutional control and may have engaged in unfair trade practices in violation of Florida’s Deceptive and Unfair Trade Practices Act (FDUTPA), Chapter 501, Florida Statutes. Since your office is the enforcing authority of FDUTPA, I am requesting that the NCAA’s admitted wrongdoing be investigated immediately before the NCAA’s witch hunt against the University of Miami causes further damage.

Among other acts of wrongdoing, the NCAA was so desperate to gather evidence against the University of Miami that it made improper payments to a convicted con artist and his lawyer for information that it was not allowed to obtain. The NCAA, which does not have subpoena power, paid thousands of dollars to the con artist’s lawyer to gain subpoenaed witness testimony in a bankruptcy case, so that the forbidden information could be used in its investigation. Not only does this abuse the bankruptcy process, but it clearly circumvented the limits of the NCAA’s authority. All of these improper activities occurred in South Florida, within the jurisdiction of your economic crimes division.

In addition, the NCAA advised potential witnesses that their silence would be interpreted as validating the claims of the criminal, Ponzi schemer Nevin Shapiro. This unethical behavior and lack of due process by the NCAA should not be tolerated in our State.

The NCAA’s admittedly corrupt investigation has now dragged on for more than two years, and the University of Miami has suffered through this abuse of power. While the NCAA has been paying off a criminal and his lawyer for forbidden fruit, the University of Miami has tried to work cooperatively with the NCAA and has even self-imposed serious sanctions that included a two-year bowl ban and a conference football championship game.

I strongly feel that the NCAA’s abuse of power and payoffs must be scrutinized to the fullest extent, especially considering the NCAA’s role as a regulatory institution of more than 400,000 students across the nation. Thank you for your consideration.

Florida attorney general's office confirms it is reviewing request to investigate NCAA's probe of UM.
 
The enemy of my enemy is my friend.

Been repeating this over and over since the YAHOO story came out. We must identify and leverage every enemy, competitor, person or entity that can gain from the relative demise of the NCAA (or at least their investigation).

The first enemy of Charles Robinson that we came across was Whitlock. He carried a tiny torch railing against Robinson.

Now we need the real stuff. This might not help itself, but it's the type of stuff we should hope for.
 
Anyone on this board that lives in the good Senator's district should email his office thanking him for his interest in a very just cause.

Did Hatch's cause include the willful and pervasive corruption involved in the present matter? I doubt it. There's a laundry list a mile long of egregious conduct spearheaded by the ncaa in its attempt to bury UM for Florida's Attorney General to sink her teeth into.

Thank you negative Nancy. Except that you are not doing a good job. Orrin Hatch did not have a criminal act committed by the NCAA to go after. From all accounts, the NCAA interfered in a federal bankruptcy case using it for purposes not related to the case or the benefit of Shapiro's victims. It paid money to Shapiro that should have gone to the debtors (since Shapiro owed money to his victims)
