The point of this is to prevent her from disclosing all of their dirt. That will allow them to try to ***** us.

That screws Perez in her investigation and any potential hearing with the Florida bar and that information will come out anyway. Not good for her at all.

Their communications with her were presumably not to secure legal advice, as is normally required to create a privileged communication; rather they seem to simply have been for her to carry out questions in the bankruptcy proceeding on their behalf.

No, the privilege is broadly construed to protect the client (the NCAA). You do not need to be in litigation or any adversarial posture for the privilege to attach.

But it sure smells to first admit the association with Perez was improper, but then to put up the privilege as a shield so you don't have to divulge exactly what was improper.

Good point. To claim attorney client privilege, wouldn't they have to admit she was working for them during the bankruptcy proceedings?

No doubt the NCAA will now attempt to spin it that they did nothing improper which is tough since they already admitted they did. They'll use the Washington law firm's legal opinion as justification but this whole thing is headed to court over a number of issues unless Emmert gets a settlement with Shalala. The actions of the NCAA acting with monopolistic powers puts them in potential conflict with anti-trust laws.

He can admit to the f#ck up/fraud and still hope to keep the correspondences and words exchanged between the NCAA and Pig ***** Perez confidential. NCAA is going to do whatever it can to keep the lid on just how seedy that can of worms between it and Pig ***** Perez is.

I read that article as saying that Humphrey, who works in enforcement, said (when she first notified parties over the phone that the NCAA had been involved with Perez) that the NCAA was going to claim attorney client privilege. In the same conversation she said basically said the NCAA got great info from working with Perez (obviously, that isn't going to mean anything) and that they would claim attorney client privilege with respect to dealings with Perez (this could also be outdated at this point). The whole call was enforcement flexing its muscles - just like they tried to do in paying Perez in the first place. At this point, I wouldn't attach any significance to anything Humphrey said during that call, unless Emmert comes out and says the same thing.

Based on the news he reported, I have no idea why the author felt he had to talk to a lawyer and ask about attorney client privilege. There is nothing to this story at this point.

Good point, two separate clients with separate interests share information that the third party is not privy to. Couldn't that break the atty client privilege rule and force disclosure?
