I was on another board that was talking about conf realignment and I learned something about another guy that’s trying to be a cog in all this. The guy that’s been making those realignment charts on X, Tony Altimore, was on a podcast once and he’s not this young guy on his socials that he’s trying to portray himself as, but he’s actually a middle aged guy.

I guess it's the lesser of two evils. It's still better than being in the mountain west.

Wait until you see what sort of media deal is offered to the ACC after FSU/ Clemson / UNC bail. Currently deal will be revised down for the balance of the term which ends 6/30/27. Then ... the ACC goes looking for a new media contract ... from ?? Apple / Amazon streaming only? Based on actual viewers? Miami better get out to the P2 now if there is a landing spot ... even paying the $120M exit fee will be a bargain ... even at half share for 4-5 years.

But it seems like there isn’t a P2 spot for us at this moment. We get out and where do we go until we get the invite?

He means that it "seems" like at the moment UM has no back channeled confirmation of a spot if they DO leave the ACC. Nobody is leaving without a guaranteed spot ... confirmed via back channel conversations. Formal invites come AFTER a school leaves, with media rights.

That’s how I understood it. My question is how much back channeling can actually get done without the risk of lawsuits coming into place?Because everything leaks now days (anonymous source).

Anything short of a contract offer I would imagine. A key thing to remember is that every ACC member has THE RIGHT as per the ACC bylaws, of leaving the conference. They just need to advise and currently at least, pay the $120M exit fee. It would be totally expected that someone who wanted to leave would make some inquiries regarding a new home.

You always have a right to breach a contract — economical breach is oft times a real option. I understand, technically, exercising a right in a contract is not a breach. But my point is, in regards to (backchannel) dialogue, the third party needs to be careful about tortious interference. I would think that is the only real legal impediment to any such dialogue. Inquiry is not tantamount to anticipatory breach, so I’m not aware of any legal risk UM has in direct inquiry — in other words, don’t know why, from UM’s perspective, using a backchannel would be necessary.

This info is what I have been waiting for to come out. ESPN has to have known all along that some of these ACC teams are worth much more viewership #'s and therefore more $ by playing more quality opponents in better conferences. ESPN not extending the GOR from 2027 to 2036 before the original deadline expired was a clear indicator ESPN wanted to spend their $ more wisely.

The Big and/or SEC has to avoid being sued for tampering by the ACC and teams in the ACC have to avoid being sued as well. Miami was sued by UCONN when they left the Big Least!

I’ve also pointed out to him multiple times that his TV network data is irrelevant since the Nielsen numbers in his charts don’t include any ACC Network data. He includes that point in a footnote, but it makes the data meaningless for the conference.

And wasn’t the ACC Network unavailable in South Florida markets for the first few years? I seem to recall there being complaints and issues of people not having access to the channel on their cable networks, but I wasn’t local at the time. That would also skew the data.

Also, Miami definitely did NOT vote in favor of suing FSU. I’m also a (former) attorney, and I read through FSU’s Response to the ACC’s Motion to Stay. It’s covered in Exhibit C - the UVA President’s Affidavit. The UVA President states that representatives from Duke, Syracuse, Wake, VT, and BC were the other schools that consulted with the ACC Management while the lawsuit was being prepared at his request, and that these representatives “agreed with this interpretation of the Conference Bylaws and the decision to proceed forward without a full meeting of the Board of Directors.”

He never mentions Miami or Rad at all. We were definitely only at the first meeting.

Bingo. Once path into the new conference (bigten) is clear, it opens the door for public announcement.

The other thing Miami is being very mindful of, is with the fsu/clemson suits and countersuits, they don’t wanna make their exit from acc unnecessarily messy

As much as some people wanna bash Rad, they are handling it the most strategically advantageous way possible

As for the realignment info, I'd be surprised if they announced they were leaving the conference without a landing spot. If they did leave and played as an independent, it would indicate that neither the BIG or SEC extended offers to them. Also, one reason why I don't think the ACC settles is because the minute they do, you're gonna have us and every other team in the conference filing a lawsuit to get to the same result.

I think we are waiting until FSPoo, Clemmie, and possibly UNC leave and each pay their 120 million...then we take our share of that buyout to help finance our exit.

At the end of the day it is chump change and they are most likely NOT paying the $120M at face value. There is more "****" to hit the fan in potential charges against the ACC regarding mismanagement. The best thing UM could do is get together with enough teams to have the 8 required to DISSOLVE the ACC before Cal/San/SMU join on July 1, 2024. Then there is NO exit fee or media buyback. Question is does UM have a seat at the big boys table, even with a partial share?
