The NCAA and these schools just have to admit players are not employees, let them collectively bargain, and move to every nil deal is a full 1 year deal period. You sign a LOI you are there a yr, you sign an nil deal there is no leaving after enrolling in spring…

Miami has completed the overhaul of its secondary by landing of one of the best young DBs in America, Xavier Lucas.




The 6'2, 200-pound Broward County native was the second-highest graded player on the Wisconsin defense as a true freshman. According to PFF, Lucas posted a 77.5 overall rating, a 75.2 coverage grade and a 76.8 tackling grade. He made 18 total tackles with 2 pass deflections and an INT.



Lucas instantly becomes one of the fastest corners in the ACC. In the spring of 2024, Lucas posted a personal best 10.49 in the 100M.



Lucas reunites with his former Deerfield Beach teammate, Freshman All-American OJ Frederique. Miami has added four additional blue-chip transfers in the secondary with Charles Brantley (Michigan State), Ethan O'Connor (Wazzu), Zechariah Poyser (Jacksonville St.) and Emmanuel Karnley (Arizona).

Lucas attempted to enter the Transfer Portal several weeks ago. Wisconsin refused to enter his name in the Portal within the time required by rule. Wisconsin claims Lucas signed a revenue-sharing agreement pursuant to the House antitrust settlement. However, the settlement has yet to be approved, and the NCAA has been unable to legally restrict player movement after a series of court defeats. Lucas's attorney Darren Heitner said Lucas has yet to receive a payment from Wisconsin.

When Wisconsin failed to comply with standard protocol, Lucas withdrew from Wisconsin and enrolled in Miami. The NCAA will seek no further action.


@DMoney is there any concern about his eligibility at Miami since he never officially entered the Portal and the potential for some court case over this revenue sharing deal? Would hate to have him sit out or miss any time over this crap

So, just to clarify for myself and anyone else who is wrapping their brain around this whole situation,

- IF the revenue sharing proposal passes, Wisconsin technically owns Lucas's NIL rights for two years since he signed a contract NOW, when there wasn't any actual legal reason they could have him do so...

- Until that happens, Miami can have him participate in NIL with their collective.


- It would seem that there could be further legal wrangling down the road should Congress finally pass the revenue sharing agreement.

- I know the contract he signed was given to all BIG10 schools to use. Is it legal? Or would that be the main point of any future litigation?

It's hard to be sure, but I believe that this:
The agreement, a Big Ten-issued template form, binds Lucas — and all players who sign — to that specific school and grants that school a player’s non-exclusive rights to use and market their name, image and likeness. The agreement prohibits the player’s rights to be used by any other school while permitting him or her to sign outside marketing agreements, according to those familiar with the template.

Refers to the revenue share which was to have been paid by the school to the player. I believe the last clause refers to 3rd party NIL (collectives and legitimate endorsements like Cam with Bose), so even if the contract he signed was enforceable (suspect not), he still should be able to sign NIL agreements with the Miami collective and brands.

I suspect the permissive parts of the House settlement - rev sharing/3rd party NIL clearinghouse/etc - have just been obliterated along with the rules regarding the transfer portal.
