I think both her and Emmert know that if we dont get anymore sanctions, Ohio Taint, UNC, USC, UCF, Boise St, etc will probably think about legal action as well. Unless USC can get those documents unsealed, they might be the only one who has a legitimate case, as the others went through the process and didnt have any fraud committed against them.

Not to mention the black cloud that has been hanging over our Athletic Programs for the last 2 years. We wont skate, but compared to what it couldve been, we'll probably be treading through a couple of inches of snow with LL Beans brand new snow shoes on and a cold bud light in our hand.

The big difference here is the other schools would have to prove that the NCAA acted against their policies and procedures in their investigation to even be considered for a settlement. I pretty sure that would be the stipulation if it were to go down just for the NCAA to CYA.

They still won't ever "settle", at least not publicly, because every other school that ever had sanctions levied against them would sue the **** out of the NCAA because they didn't get a chance to settle. The more likely scenario is that the NCAA quickly "wraps up" the investigation and hands down some token sanctions which would amount to time served and minimal scholarship losses.

Question for our legal experts, say the NCAA removes some or all of the tainted evidence after the "independent review" then hands down the NOI we respond and have a hearing, how can the committee that delivers the penalty not be prejudice against us thinking there was even more evidence that they are not seeing and thereby judge us more harshly. They have already been poisoned by this have they not?

Exactly. I'm not expecting us to get nothing. What I am absolutely expecting is that we should not get anything more than Ohio Taint or UNC got. The NCAA would be smart to work something out with UM even if it's behind the scenes where both parties can come to an agreement on the additional penalties.

Let's not lose track of the fact that these fraudulent unscrupulous incompetent "investigators" have already had us on probation for 2 years while they were committing their misdeeds. How much extra time did they waste during this witch hunt f#cking around with stuff that they shouldn't have been f#cking around with? However, I've got 20 years of real legal experience studying and participating in settlement negotiations. I can assure you men from my vast experience that the party with the hammer calls the shots.

This case went from the NCAA holding all the cards and us having to suck their d#ck and quietly eat sh#t to us now having the hammer. You can see that very clearly if you know how to read the tea leaves. President Shalala's public statement was an alpha move. A move by a hammer holder. She made no such statements throughout this entire sickening foot-dragging witch hunt. Suddenly, she's making strong public statements. Read the tea leaves, men. The tide has turned on this one.

This case is ripe for a back room deal. Of course, the parties can agree as part of that settlement that they will go through the whole sham of the NOA and the next step of the COI hearing. But the NCAA would be wise to tread carefully here. Their entire organization can be blow to sh#t, and a LOT of people can lose their cash cow if they push UM here.

They don't want another lawsuit where they are made a mockery of. Trust me. How is it going to play in the court of public opinion that an organization that clearly lost institutional control is trying to penalize UM for the same thing?

Excellent. Just because the NCAA committed fraud in their investigation of us doesn't mean they did the same thing with UNC and Ohio Taint and the others. Those schools can't sue the NCAA just because UM has a valid case against them. They would have to prove that the NCAA did something similar in their cases.

Personally, I think the entire fake investigation is compromised. Let's not forget the extortion from the ufag *****. The whole thing's been a witch hunt and fishing expedition where they gathered information they weren't entitled to gather. How can they formulate a fair penalty when their own investigation was corrupt? That's like trusting a guy who robbed you of everything you own to return everything to you on his own.

What Chise said. To add, this case is unlike almost every other that the NCAA has done. The only other time where it has become public knowledge that an investigator screwed the pooch was the Shabaz case. And we all saw just how fast the NCAA dropped that investigation. The last thing anyone on the NCAA's side wants is for any more dirty laundry to be aired, they risk losing the rest of their credibility if any other "surprises" come up, and if any of these investigators were involved in other cases, all of those cases could lead to lawsuits. The NCAA needs this to go away more than Miami does, and the best way to make that happen is to make UM an offer it can't refuse.
 
I think the extended PR hit the NCAA would take from extending this is not worth it to them. Miami has already punished itself with two bowl bans, and the ACCCG, along with having to recruit under the shadow of this thing for two years. The NCAA needs to show they themselves have some credibility and put an end to the investigation and put some oversight in place to stop this from happening. It's pretty clear that once they start investigating, they WILL find something to justify the investigation.

If they do continue with it, Shalala needs to go on the offensive, citing the punishments already served and everything they've already done, including in Emmert's own words, the extraordinary cooperation Miami showed in the investigation.

- Has been commended by Emmert on their "cooperation" throughout this process
- Probably the most stringent Self-Imposed penalties since SMU sat out an extra season..

Complete Contrast to UNC, OSU or USC who did not cooperate or take meaningful self-imposed penalties........And the NCAA was still looking to Rape us.....

Even if the NCAA is able to reclaim some sense of legitimacy after this.......How will they ever get another school to cooperate again if they don't cut a deal with us at this point? There looks to be no benefit to cooperating at all.

Any "experts" asked for their opinion in this will be talking strictly out their ***, because the is no precedent. For the first time ever an organization that acted with such autonomy for so long has now had their investigative actions put on display for all to see in scandalously embarrassing fashion. And a public, which in this case was almost unilaterally behind them to hammer UM into oblivion thanks to Robinson's salacious piece and their already ingrained bias, has shifted so viciously against them, to try and suppose that they would continue in any predetermined way is foolish.

You're dead on with your post, buddy. I don't see how the NCAA could ever expect anyone to cooperate with them in the future if this is what extraordinary cooperation gets you. It got us a bunch of blood-thirsty jackals disguised as "investigators" who broke all of their own rules in an attempt to hang us. They jumped in bed with and tossed the salad of convicted Ponzi scheming liar with a publicly-stated vendetta against the party they were prosecuting. If this is what "extraordinary cooperation" gets you, then why bother?
