The University failed it's title 9 obligations. That puts it's ability to get FEDERAL money at risk. The University is guilty even if Winston is innocent. As a tax paying citizen, I hope they burn for this. Federal legislation put in place to protect citizens is not a joke. Florida STATE University was grossly incompetent and will ultimately be held accountable.
 
This is winston last year in tally to much heat in that town.... i say he take the money and run....

What does Title IX have to do with it?

Title IX contains 10 parts. One of those parts specifically relates to sexual harrassment and how Federally funded institutions are required to deal with sexual harrassment claims from a compliance stand point. If they violate Title IX they open themselves up to liability under the statute and ultimately could lose funding.

It is clesr thst FSU didn't do what they were required to do under title IX to protect the alleged victim. I hope they get slammed.

This is yet another case of an attorney seeking out the deepest pockets and going after the money. The university well settle rather than having their name dragged through the mud for an incident that was not something they could control. In the end, Florida tax payers lose! ....yet another abuse of or legal system.

The letter illustrates multiple examples of Title IX requirements as they relate to sexual violence, and makes clear that, should an institution fail to fulfill its responsibilities under Title IX, the Department of Education can impose a fine and potentially deny further institutional access to federal funds.

What are a school’s obligations under Title IX regarding sexual violence?

Once a school knows or reasonably should know of possible sexual violence, it must take immediate and appropriate action to investigate or otherwise determine what occurred.
If sexual violence has occurred, a school must take prompt and effective steps to end the sexual violence, prevent its recurrence, and address its effects, whether or not the sexual violence is the subject of a criminal investigation.
A school must take steps to protect the complainant as necessary, including interim steps taken prior to the final outcome of the investigation.
A school must provide a grievance procedure for students to file complaints of *** discrimination, including complaints of sexual violence. These procedures must include an equal opportunity for both parties to present witnesses and other evidence and the same appeal rights.
A school’s grievance procedures must use the preponderance of the evidence standard to resolve complaints of *** discrimination.
A school must notify both parties of the outcome of the complaint.


THEY DID NONE OF THE FEDERALLY MANDATED ABOVE. NONE OF IT! The Federal Government doesn't give a **** about Florida STATE University football. They do care about gross incompetence and law braking.

The University waited over a year to address the issue and only did so after TMZ reported it. They covered it up to protect a football player. FAIL

On another note....why do players constantly ***** up the Heisman pose?

Yes, TPD is gonna burn because they impeded any chance of effective prosecution with legal malpractice by delaying & sitting on the case and investigation! In reality, this delay & suppression "in the investigation hurt the search for both evidence and witnesses in the case. For instance, the Tallahassee detective who originally worked the case did not go to the bar where the woman said she had been drinking to look for surveillance camera footage that might help identify people there that night -- perhaps even the person who bought her the shot. When investigators from Prosecutor Meggs' office sought that footage in November, they learned it had been erased months earlier."

FSU is gonna burn and pay because of the various Title IX violations, but FSU got paid in advance before this potential civil lawsuit. The best thing going is for FSU to settle this case because the suppression of timely investigation disallowed prosecution to have any video evidence of Jameis or Darby dropping Ecstasy (or WhateverTH it was) in the girl's glass in addition to any witnesses of the bar scene and the prospective Girlnapping, AND all this facilitated FSU to have its star QB AVAILABLE to not only secure the coveted Heisman as College best player, but for FSU to secure the National Championship as College best team. Of course, all this hauled in millions of dollars into the coffers of FSU -- notwithstanding the prestige that also hauled in prized recruits who want to play for Champions -- therefore, this haul certainly will greatly mitigate any burn or damage to the FSU brand.
