Miami prepares to file a suit against NCAA-Time served enuff

I said saber rattling. I did not say a bluff.

The threat of action can sometimes get the job done.

And if it doesn't then you draw the sword and cut.

Threat of action is a better term. Point is UM has zero interest in suing the NCAA, but the threat may move things along.

Why wouldn't Miami have any interest in suing? You guys have to realize the implications this would bring. This would bring the entire BS system we call "amateur athletics" to it's knees. Look at where some of our coaches went??? You think Stoutland and Panunzio being at Bama wouldn't come up? Bama is the $EC darling right now and couldn't do any wrong in the NCAA's eyes. This could cause a **** storm of massive proportions and bring the NCAA to it's knees. Miami didn't do anything that every major program is doing right now in terms of recruiting. The NCAA picks and chooses who they want to attack and it's based on a good ol' boy club mentality. Miami is a small private school that they love to hate and now Miami can prove it.

I can think of many reasons why UM isn't bluffing. How about lost bowl revenues for one? How many millions did that cost between two bowl bans & missing out on the ACC championship game? Not to mention there's some speculation of Emmert's actual involvement in all of this & they may have violated Federal law. That would be a enormous whoopsie! We are posturing & if they decide to fight we'll shove it right down their throats!
 
Remember the NCAA agreed to a joint investigation and to share information; quite obviously they didn't and the whole entire process is tainted and must be thrown out.

Being the first up the hill in a battle to bring down the NCAA sounds great to fans but in reality is a last resort and not a first option. Suing the NCAA would involve a massive amount of time and money and would take forever. What Miami wants is for this mess to be over with quickly. Doesn't mean Miami wouldn't go that rout if the NCAA still tried to blast Miami with harsh sanctions, but its certainly not an ideal situation to be suing an organization of that magnitude. The NCAA, however, wants this mess over too so I suspect they will work with Miami on a relatively quick solution to end this investigation.
 
I trust DS in this. She's absolutely the best person I can think of to manage this situation.

I totally agree with this post. This is somewhat akin to a divorce where both sides want to work it out, and litigation is the last resort.

It's my understanding that UM did not miss out on bowl money with the ACC revenue sharing bowl plan.

brand recognitino, etc.. they can show financials on how much money they lost etc. that part is easy. the hard part is proving if the NCAA was targeting the Canes unfairly and breaking their own rules..

the courts hammer anyone that brakes their own rules to punish someone .. they consider it fraud.

Emmert = $EC............I have been saying this for several years. People in the state of Alabama call me a conspiracy theorist!! Whatever!!

They have zero interest presently. If the NCAA goes along with what UM wants, then there won't be any need for a lawsuit. If the NCAA goes Roger Goodell, then UM would be foolish not to fight back and fight back hard. We've got the hammer now.

They have zero interest presently. If the NCAA goes along with what UM wants, then there won't be any need for a lawsuit. If the NCAA goes Roger Goodell, then UM would be foolish not to fight back and fight back hard. We've got the hammer now.

one can only hope.

i'm not sure how much leverage that university has as far as how quickly things get resolved, (the NCAA doesn't care about a speedy resolution or how much UM twists in the wind), but I agree the "public perception" may have swung in our favor as well as the legalities of the whole thing.
