The only problem is that pay for play or making it conditional on being at a certain school is against the law.

they can't base it on in game performance otherwise its illegal and pay for play. hes still on the team and he can still perform his obligations related to advertising etc.

Ok… I was confused as to his status with not having his waiver approved.

Not approved to play this season but he’s on the team…. Got it.

Actually his NIL shouldn’t have anything to do with playing time at all, or it becomes “pay to play”

If he fulfills what’s laid out in his NIL contract he will get paid regardless of his playing time.

Anything else and FSU has a lot more problems on their hands than just a waiver denial…..

Yes, that is true. There might be ELEMENTS of performance (you have to make personal appearances or sign stuff) that would be HARD to do in a location outside of your "university", but they cannot make the NIL conditional on play or university.
