A-State to sue Miami if payment not made for cancelled game

But it turns out Miami preemptively sued Arkansas State on Feb. 13, seeking declaratory relief from a Miami judge, essentially asking for Miami to be declared in the right and the case to be dismissed.

Wonder what their ****** three-person General Counsel office will do when it turns out they can't litigate this in front of a bunch of hillbillies in Western Arkansas.

Also notice how much better written the Miami complaint is than the ASU one:

So the plot thickens. Now that's a complaint: well-written, coherent, thoughtful. You know, unlike the contract itself or Ark St's complaint.

Fun fact: one of the two attorneys who signed the pleading on behalf of the University of Miami graduated law school from FSU. We can only hope he didn't infiltrate the law firm to try and sabotage the lawsuit.

ASU fan here. There are several issues in this matter but the primary one concerns the rescheduling of our game. UM had the opportunity to reschedule in 2020/2021 but chose to offer dates in 2024 and 2025 which were unacceptable to ASU. UM claimed it had no available dates until the later years but this was not true. Dates were available in the time frame we desired but your athletic department did not want to schedule our game because the earlier dates claimed to be filled were set aside and available for scheduling FCS opponents. It was not impossible to reschedule our game but rather inconvenient for UM to do so. ASU believes it went the extra distance in an attempt to work with UM but your UM failed to respond in kind. Keep in mind that we offered to move the game to Friday, offered to pay for the UM flights, offered to provide lodging, and offered our indoor work out facility in the event the teams return would be delayed. We asked your UM to reschedule our game immediately following the cancellation but was told to wait until after the season so he was aware of our desired dates early on in the discussions.

Miami should schedule the makeup game for one week before the LSU game and use it as the last scrimmage of Fall camp. We would be better prepared for LSU and get to hurt some of them *&%$* from ASU.

If we’re starting a new QB I would rather LSU have much less info on what and when he’s going to to do something. Think it gives us an advantage.

Welcome and enjoy the board as it is an excellent source of information on Miami football. As a lower-level program, I can understand that ASU feels it is critical to play Miami ASAP. But, to major programs, a couple of years difference is NO difference. Enjoy the legal show because your school is about to be taught a lesson. Oh and good luck on scheduling any power 5 school again.


PS. When we do play in 2022-2023 take Miami and the over because we will put up over half a hundred on ASU.

I am STUNNED. This is absolutely great news. It now becomes even funnier, in hindsight, that the ASU idiot attorneys telegraphed the date on which they would be filing a lawsuit, thus giving us the time to be "first-to-file".

Brilliant.

It will still get removed to federal court (in all likelihood, assuming the ASU attorneys took Civ Pro and whatnot), but now it will be in the Southern District of Florida.

I might actually start to like Blake James (as long as he starts improving our OOC scheduling). A tear is forming in the corner of my eye.

Your ****** little school is gonna get a tiny payout which wont be public and UM will not be gracing your ****** little school with our presence. Oh and youll never get a national championship winning power 5 team to come to your ****** little campus to play on your ****** little field.

ASU is desiring a return game following our visit in 2014. Your athletic department desires to schedule an FCS opponent which of course is a lower football division. We will be pleased to host UM and give your team the opportunity to post what ever score it believes it can achieve. State is an equal opportunity host for all scheduled opponents and believes its critical to follow through on a handshake or formal contracts.

Unreal. One of their named partners is a graduate of UM Law going after The University of Miami on behalf of Ark St.

Haven't seen this type of treachery since Maria Elena Perez, who has since been disciplined by the Florida Bar for her actions in the Nevin Shapiro case.
