A-State to sue Miami if payment not made for cancelled game

JONESBORO, AR (KAIT) - Arkansas State University may file a lawsuit against the University of Miami over a football game that was cancelled during the 2017 season.

A letter released to Region 8 News from A-State indicates Miami must pay the Red Wolves $650,000 by Thursday, Feb. 15. The amount was based on a contract signed between the universities in 2013.

The game, which would have been the home opener for the Red Wolves, was scheduled for Sept. 9, 2017, and cancelled as Hurricane Irma approached Florida.

Furthermore, the letter indicated Miami had no intention of paying the sum during a telephone conversation.

The letter concluded:

Unless Miami changes course on or before February 15, 2018, we will begin the process of filing a lawsuit against the University of Miami in the appropriate Arkansas state court.

ASU System General Counsel Brad Phelps had the following statement:

It is very unfortunate that we have been unable to resolve this matter, and we remain hopeful this can be worked out without the need for litigation. Ultimately that will be up to the University of Miami.

We need to stop giving home games to these pathetic sun belt schools. It’s the biggest deal in the world for them and only ends in disaster. We beat the **** out of the mountain weirdos and then their racist baton team accused our players of roughing them up. Same **** with these losers. Good luck claiming that the force majeure clause doesn’t apply.

We should NOT give these pathetic losers a home game. They don’t deserve to be graced with our presence.

Looks like they're trying to strong arm Miami into rescheduling to get the publicity that they need. Any half assed lawyer knows that it's extremely difficult to win this case unless there was a clause relating to "Acts of God." Seems like Miami would be excused for the breach on impossibility, improbability or even equity.

If there is a clearly delineated force majeure clause in the contract that allows Miami an out, the hillbillies have a hard case to make.

It all depends on the wording of the contract around the clause.

Don’t discount the venue either, sadly.

On a serious note, this will be a very easy case to settle depending on the wording of the contract.
 
From reading another article they're only threatening to sue because they wanted a 2020 or '21 home date and Miami said no, due to the openings they(Miami) have are slated to be home games.
