Shalala, Miami ready for a fight after NCAA releases allegations

With the preliminaries out of the way, Donna Shalala is ready for the main event.

In other words, the NCAA better get ready for the battle to continue in court. Or worse -- Capitol Hill.

For the second straight day, Miami's president came out smoking against the NCAA. Shalala released a scathing statement Tuesday night in the wake of her school receiving its notice of allegations in the Nevin Shapiro case. The AP reported that the NCAA has accused Miami of lack of institutional control.

Shalala is thinking the same thing a lot of us are: Who's calling who out of control?

From her statement: “Many of the allegations included in the Notice of Allegations remain unsubstantiated.”

In other words, the NCAA better be darn sure of this one. Monday's dark day that included the firing of enforcement director Julie Roe Lach further clouded the investigation. Followed up so soon by the NOA, the NCAA seems sure of itself in going forward. If there is anything, anything -- another “misstep” (the NCAA's words) -- in this investigation by the association, the entire enforcement process will be at risk.

For now, the case seems to be headed for court -- or higher. Don't forget that Shalala is a powerful Democrat who was a former Secretary of Health and Human Services. Who knows how much NCAA damage she could wreak with a second-term Democrat in the White House who has shown more than a passing interest in sports?

One source close to Miami described school officials as “pretty taken aback” at the stance taken by the NCAA enforcement staff. Shalala disputed the NCAA's findings on almost every level. In Monday's statement following the Roe Lach firing she said the school should get no additional penalties. Miami's self-imposed penalties included a two-year bowl ban, player suspensions and holding back of scholarships.

Tuesday's developments clearly indicate the NCAA believes Miami should be penalized further.

The school has 90 days to reply to the NCAA. The earliest Miami could get before the infractions committee is probably August. That would mean the case wouldn't be decided until October or November.

Until then, it's going to be -- if nothing else -- entertaining.

Shalala flat-out brought the wood Tuesday. “Institutional control” is the NCAA scarlet letter and seems more than ironic considering how the institution called the NCAA has been out of control in this investigation.

More from Shalala who said: “Many of the charges brought forth are based on the word of a man who made a fortune by lying. The NCAA enforcement staff acknowledged to the University that if Nevin Shapiro, a convicted con man, said something more than once, it considered allegation the ‘corroborated'”.

She also said, “most the sensationalized media accounts of Shapiro's claims are found nowhere in the (NOA) … the NCAA enforcement staff could not find evidence of prostitution, expensive cars for players, expensive dinners paid for by booster, player bounty payments, rampant alcohol and drug use …”

Shalala also claimed the NCAA failed to interview the late Paul Dee, the former AD. Dee was in charge of the department during a portion of the time Shapiro allegedly ran rampant through the football program.

“How could a supposedly thorough and fair investigation,” she said, “not even include the Director of Athletics?

“Finally, we believe the NCAA was responsible for damaging leaks of unsubstantiated allegations over the course of the investigation.

“Let me be clear again: for any rule violation … we have been and should be held accountable … We deeply regret any violations but we have suffered enough.”

It's clear that the main event is coming -- without gloves. Shalala has taken them off.
 
The NCAA will leak stuff out so Miami will take a PR hit and deflect the public eye from them. I too would love to take the NCAA to court, but that could be bad for us because we become an open book and everything comes out. Would be very, very ugly.

What is very ugly against us that has not come out yet? Can you please elaborate? Maybe you have been living under a rock the last 2 years and have not heard over and over again all the venom Yahoo! Sport has been disseminating.
 
I think the NCAA charged Miami with just enough to justify the punishment Miami has already self-imposed. We've imposed a lot, 2 bowl bans, 3 postseason games, multiple practices, limits on in-home and official visits, and 5 scholarships is a lot of sanctions. On what planet is that not harsh? UCF got less for LOIC, so at this point I'm not worried.

This makes sense to me,and would make you wonder if the NCAA and UM reached some understanding of how the process would unfold and the eventual outcome. It would be smart for both sides to do so, but I'm not sure that was a possibility, given all of the issues the NCAA confronts arising from its other investigations.

Good point. I think now Donna just wants to get a an expedited decision from the committee so that there isn't a public record of findings.

I am begging for the political branches to get involved. I want a program of extreme political harassment. You're ******* with mafioso here. Make the Plumbers look like a boy band. The full weight of DC needs to be unleashed. Call in every favor you got. This isn't about avoiding sanctions for me anymore. I want lives and careers ruined.

I want ******* human suffering. Do whatever it takes. Bring Washington DC to bear.

I'm tired of their arrogance. It's time they got knifed in the throat.
 
Can the portion of Miss Shalala's statement copied below possibly be true?

Think about it for a minute. This statement was crafted, discussed and legally vetted before it was released by a former Cabinet Secty and President of a major university. If indeed the NCAA was THIS dismissive of the process that is as significant and simple indictment of the whole mess that we have seen in the whole two years.

You think Donna comes out and throws that uppercut to Emmerts jaw if an understanding had been reached?
 
How many big time political people has Donna had speak at The U? I recall alot of times where we had Presidents of Supreme Court Justices speak. Maybe Donna can get the Dali Lama to comdemn the NCAA.
 
Donna put them on blast. Im glad she did, but its concerning knowing the ncaa answers to nobody and she is obviously ****ed about something

There were just 2 SCOTUS justices on campus.

Yeah to NorthFla's point I think he's on to something with charging us just enough to warrant the unprecedented two bowl bans. Without the loic they wouldn't be able to substantiate such a charge. And I think Donna is going on the offensive to say, hey mother****ers enough is enough. I don't give a **** how you word it but enough is enough. And she is backing it up with a little thing the NCAA should have used --- facts. She's saying ok that's the charge, well we've had our due and that's it.

Exactly. They can charge us with LOIC, then we go before the committee this weekend and get off with time served. Then Donna does crotch chops in Charles Robinson's face

Shalala is the Yoda of University Presidents. She seems small and wise but do not i repeat do not challenge her to a light saber duel.

it is a great night bc we've all always wondered how much she cared and how fierce she would be. Well this answers and squashes all such questions. She smells blood and is a lion on the hunt to end this ****. We couldn't be in better hands. She has been patient and played this perfect. Now she says enough is ******* enough. And I love how her silence and patience that some badly misconstrued as lack of care or vigilance is now playing like the Ace of Spade, King of Spades, Queen of Spades, Jack of Spades, and 10 of Spades. Like a boss
 
Proud that Donna is the President of UM. She is the perfect person to be in that position right now
