Wouldn't the courts be closed on Monday due to the holiday so it would be lawsuit issued Tuesday. I guess they could have it ready to go and file it towards the end of today if it looks like it will not be resolved. Honestly should have filed the lawsuit while pursuing a non-court resolution. At the very least it shows WI you are not playing around.
