Yep, the victim orders the investigation according to my favorite actuary/shopping cart jockey. Sorry, after he turned tail and ran in that thread, I have not been actively looking out for him or his weak *** arguments (I think I can get a charity deduction for it). They either decline or want to delay the decision to go forward with university or criminal proceedings. Guidance from the U.S. Dept. of Education (April 2011 "Dear Colleague" letter) makes it abundantly clear that the university needs to take these wishes into account. To rush victims or disregard their wishes not to proceed would be re-traumatizing and hinder their recovery.

I'm a homer for saying the odds on favorite in Vegas will repeat? We have two hard games, UF and ND at home. It's not homerism to,think we could win again. just deal with it.

Why is this such a difficult concept?

If the victim says "I don't want an COC hearing!", then it's illegal for FSU to have the hearing.

This is clearly stated in the Aprill 2011 Obama letter.
 
So a crime may have been committed and you think that FSU has a 50/50 obligation, based on how the victim feels, to have their own investigation?

Gosh, ChicagoSemenhole, I'm so glad I pleaded your case; It's always nice when you reinforce my arguments against you. First you say its "It's up to the accuser to bring forward an investigation.” and now you say the University "must balance its duty to investigate sexual assault cases." I know its hard keeping your facts straight after keeping your cart count at Wally-world, but lets get the facts out:

The DOE Office of Civil Rights IS investigating FSU for violation of Title IX. Here is a direct extract from their complaint procedures narrative:

"OPENING THE COMPLAINT FOR INVESTIGATION

If OCR determines that it will investigate the complaint, it will issue letters of notification to the complainant and the recipient."

Now I know a Math wiz from Florida Safety University with ZERO investigative experience might THINK they understand the concept of "Probable Cause" but in a nutshell, the OCR has received the accuser's complaint and they have reason to believe it may have merit, but only an investigation will prove or disprove if Free Shoes U violated the Title IX RIGHTS of the complainant. Re-stating what Florida Safety University WAS supposed to do under Title IX guidance is a moot point. The OCR will determine if they broke the law.

As for civil litigation...The great Crab Leg Heist of 2014 did your super crush Famous no favors...I'm sure you will be back trying to argue those points when the time comes, your acturial tables can't be wrong!

A College Football Vegas line in May is designed for suckers like you who visit before the season and want to put your "Big Money" of your "home" team. When my cousin (an All Big Ten DB back when it was a legit NC conferance) came to town, he always got comped on everything by the guy who ran the book at one casino.
