### An NCAA source says UM sent a strongly worded letter to the NCAA essentially saying that it reserves the right to sue the NCAA (that’s considered a last resort) and disputing the NCAA claim that the infractions committee doesn’t have the right to dismiss the case, which UM will formally request this week.

That was a lawyers letter. There's no news in that for the NCAA. They know UM 'can' sue. Anyone can sue. And the merits of the suit are what they are. The letter is irrelevant.

My guess: Basically, UM sent a letter saying 'we disagree that you can't dismiss at this stage.' They then put in standard legal boilerplate referencing a 'reservation of rights' so the NCAA cannot use the letter against UM if they do throw the case out and UM sues anyhow. In truth, UM ain't gonna sue if the case gets tossed.

I think it's a good move just to let the NCAA know another lawsuit will becoming if anything goes further. The NCAA has enough issue's with lawsuit's as it is, do they want another?

Are they smart enough to know better? I seriously think those stupid ******** will try to punish us with another bowl ban.
 
So this lawsuit, would it prevent the NCAA from further punishing Miami?

I could see it being the beginning of the end for the NCAA. I suspect if we file, others will follow suit, for past transgressions of the NCAA.

The thing the NCAA can't stomach in a lawsuit is discovery. If it got past a motion to dismss, they would be effed. That's their probleminthe USC case as well.
 
As well as the University of Buffalo case as well, saw it mentioned once before, I believe it was D Money, but that case and the USC and the threat of the Miami, is a very serious threat to the NCAA and to the discovery that you speak of
 
I thought a judge already decided that the NCAA had to release documents from the USC investigation.

He did, I believe the NCAA is appealing it though, and from what I had read before, the Buffalo case could be even more damaging, not to mention what we know of and still perhaps don't know with our case

IMO it was a little more than that. I wouldn't be surprised if this letter was to show the NCAA that their willingness to sue is real
